CMS issues proposed rule on patient visitation rights

Patient Safety Monitor Alert

June 30, 2010

Following President Obama's April memorandum asking that patients be granted the right to designate visitors who are not members of their immediate families, the Centers for Medicare and Medicaid Services (CMS) last week released its proposed rule on patient visitation rights in the Federal Register. The rule is expected to mostly affect gay and lesbian patients who can designate same-sex partners as acceptable visitors.

The proposed rules will be available for public comment for a 60-day period. After that time, the CMS will read all comments and finalize the rule.
